Terms of Service.

Effective 2026-06-04 Version 0.9 (interim) Paid subscriptions governed by the MSA

These Terms govern use of the preventionOS website and platform. Paid access is governed by a Master Subscription Agreement; these Terms apply to general use and where no separate signed agreement is in place. This is an interim version and will be updated as our terms are finalized.

    Agreement to these Terms

    These Terms of Service ("Terms") govern your access to and use of the preventionOS website and platform (the "Service"), provided by Scottship Solutions LLC ("preventionOS", "we", "us"). By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service. This is an interim version and will be updated as our terms are finalized.

    Relationship to other agreements

    Paid access to the platform is governed by a Master Subscription Agreement ("MSA") between preventionOS and the customer organization ("Customer"). Where these Terms conflict with a signed MSA, the MSA controls for that Customer. These Terms govern general use of the website and use of the Service where no separate signed agreement applies.

  3. 3.

    Eligibility and accounts

    You must be authorized to use the Service and must provide accurate account information. You are responsible for activity under your account and for keeping your credentials confidential. Each authorized user must have their own account.

  4. 4.

    Acceptable use

    Your use of the Service must comply with our Acceptable Use Policy, which is incorporated into these Terms by reference. The Acceptable Use Policy sets limits on prohibited content and prohibited uses to protect Customers, participants, and the prevention field.

  5. 5.

    Customer data and privacy

    Our handling of personal information is described in the Privacy Policy. For personal data that preventionOS processes on behalf of a Customer, the Data Processing Addendum applies. As between the parties, Customers retain ownership of the data they submit to the Service.

  6. 6.

    Intellectual property

    preventionOS and its licensors own all rights in the Service, including its software, design, and content, excluding Customer data. We grant you a limited, non-exclusive, non-transferable right to use the Service for its intended purpose during your authorized term. You may not copy, modify, reverse engineer, or create derivative works from the Service except to the extent permitted by law.

  7. 7.

    Third-party services

    The Service may link to or integrate third-party services. We are not responsible for third-party services, and your use of them is subject to their own terms and policies.

  8. 8.

    Service availability and changes

    We may modify, suspend, or discontinue parts of the Service. Service-level commitments for paid subscriptions are described in the applicable Service Level Agreement.

  9. 9.

    Disclaimers

    The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, to the maximum extent permitted by law, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

  10. 10.

    Limitation of liability

    To the maximum extent permitted by law, preventionOS will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, revenue, or profits, arising from or related to your use of the Service. Any direct liability is limited as set out in the applicable MSA.

  11. 11.

    Indemnification

    You agree to indemnify and hold harmless preventionOS from claims arising out of your misuse of the Service or your violation of these Terms or applicable law.

  12. 12.

    Termination

    We may suspend or terminate access for violation of these Terms or the Acceptable Use Policy. Termination of paid subscriptions is governed by the MSA.

  13. 13.

    Governing law

    These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws rules. The parties submit to the courts located in Delaware for any dispute not subject to a separate agreement.

  14. 14.

    Changes to these Terms

    We may update these Terms from time to time. Material changes will be posted here with an updated effective date. Continued use of the Service after changes take effect constitutes acceptance.
